1. Who we are

DARUYU is operated by Hrihorii Illiashenko, a sole proprietor (FOP) registered in Ukraine ("DARUYU", "we", "us"). By using daruyu.com or joining the early-access program, you agree to these terms. If you use DARUYU on behalf of a business, you confirm you are authorised to accept these terms for it.

2. What DARUYU is today

DARUYU is a Shopify gifting app that is currently in development. This website describes planned features. Features, screenshots, timelines, and availability may change before or after launch, and nothing on this website is a guarantee that a particular feature will be offered.

DARUYU is an independent product. Shopify is a trademark of Shopify Inc. DARUYU is not affiliated with, endorsed by, or sponsored by Shopify.

3. Early access

• Submitting the early-access form is a request, not a purchase or a contract for the app. We invite stores at our discretion and may limit the number of participants.
• Private beta software may contain bugs, change without notice, or be paused or discontinued. Do not rely on it as your only way to deliver gifts to customers.
• You agree to give accurate information and to keep any non-public details we share with you during the beta confidential.

4. Pricing

Prices shown on this website are indicative and may change before launch. Founding pricing applies only to stores we confirm in writing as founding partners, on the terms stated in that confirmation.

When the app launches, paid plans will be billed through Shopify's billing system and governed by the app's terms of service shown at installation. Taxes may apply.

5. Acceptable use

You agree not to:

• Use the website or program in violation of any law or third-party rights.
• Submit false information, spam, or automated requests to our forms.
• Attempt to access non-public parts of our systems, interfere with their operation, or reverse engineer beta software.
• Copy, scrape, or resell the website's content or design.

6. Intellectual property

The DARUYU name, logo, website, text, designs, and software belong to us or our licensors and are protected by law. We grant you a limited, personal, non-transferable right to view the website for evaluating DARUYU. All other rights are reserved.

7. Feedback

If you send us ideas, suggestions, or feedback, you allow us to use them to improve DARUYU without any obligation to you.

8. Third-party services

The website may link to or rely on third-party services such as Shopify, scheduling tools, or email providers. Their own terms and policies apply, and we are not responsible for their content or availability.

9. Disclaimers

The website and any beta software are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, availability, and non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, DARUYU is not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data, arising from your use of the website or early-access program. Our total liability for any claim relating to them is limited to USD 100.

Nothing in these terms limits liability that cannot be limited by law, including for fraud or intentional misconduct.

11. Governing law

These terms are governed by the laws of Ukraine. Disputes will be resolved by the competent courts of Ukraine, unless mandatory consumer or business protection laws of your country give you the right to bring a claim elsewhere.
